Terms & Conditions for Evig

These Terms & Conditions (“Terms”) apply to the Evig mobile application, the Evig website, purchases made through the Evig website, and related event video collection, editing, and delivery services provided by Valeur AS.

By purchasing an Evig package, using the Evig app, entering a valid event token, uploading videos, or otherwise using Evig, you agree to these Terms.

If you do not agree to these Terms, you must not use Evig.

1. Who we are

In these Terms, “Evig”, “we”, “us”, and “our” refer to Valeur AS.

2. Definitions

In these Terms:

“App” means the Evig mobile application.

“Website” means the Evig website, including the web shop.

“Customer” or “Event Holder” means the person who purchases an Evig package for an event.

“App User”, “Contributor”, or “User” means a person who enters a valid event token in the App and records or uploads videos.

“Event Token” means the unique token provided to the Customer for a specific event.

“Event Window” means the start and end date/time selected for the event during purchase or setup.

“Submitted Content” means videos, audio, and related material recorded, uploaded, or submitted through the App.

“Final Video” means the edited highlight film delivered to the Customer.

“Package” means the Evig package purchased by the Customer, including any limits, features, price, format, and delivery details shown at checkout.

3. Scope of these Terms

Some parts of these Terms apply to all users of Evig. Other parts apply only to Customers or only to App Users.

If you are an App User, the sections about App use, Submitted Content, permissions, and user responsibilities apply to you.

If you are a Customer, the sections about purchases, Event Tokens, delivery, cancellation, payment, Submitted Content, and the Final Video apply to you.

4. The Evig service

Evig allows event guests and participants to record and upload short videos to a shared event using a unique Event Token. Valeur AS then uses selected Submitted Content to create an edited event highlight film for the Customer.

The current initial package is called Evig App Package.

The exact contents, price, format, features, and any package limits are shown on the Website at the time of purchase. We may offer multiple package types in the future, such as basic, medium, or premium packages. The package description shown at checkout forms part of these Terms.

Unless otherwise stated at checkout, the Evig App Package includes one edited highlight film of approximately 2–5 minutes, depending on the quality, amount, and suitability of the Submitted Content.

5. No access to raw uploaded videos

Raw uploaded videos are not included in the Package and will not be delivered to the Customer.

App Users may have the option to save their own recordings locally on their device where the App provides this feature. However, Valeur AS does not provide Customers, App Users, or guests with access to the raw uploaded video library.

This policy helps protect privacy, security, and the integrity of the editing process.

6. Event Tokens

After purchase, the Customer receives a unique Event Token for the event.

The Event Token may be distributed by the Customer to event guests or participants. The Customer is responsible for sharing the Event Token only with people who are invited, trusted, or otherwise intended to participate in the event.

The Event Token will only be active during the Event Window selected by the Customer or otherwise agreed with Valeur AS.

The Customer must not use one Event Token for multiple unrelated events, attempt to bypass Package limits, or otherwise misuse the service.

Valeur AS may deactivate, suspend, or refuse use of an Event Token if we reasonably believe it has been misused, shared inappropriately, used for abusive submissions, or used in a way that is inconsistent with the purchased Package.

7. Event Window

The Customer chooses the start and end date/time for the Event Window during purchase or setup.

The Event Window must be reasonable for the event. For example, a wedding or multi-day celebration may reasonably run across several days. The Event Window must not be used to combine multiple unrelated events into one Package or to bypass Package limits.

Unless otherwise agreed, the Event Token cannot be extended after the Event Window has ended.

The delivery timeline starts when the Event Token closes, not when the event begins.

8. Video length, format, and orientation

The App may limit individual recordings to a maximum recording length, currently 120 seconds per clip.

The Customer may choose the final video orientation, such as vertical or horizontal, where this option is available during purchase or setup. The selected orientation may be linked to the Event Token and reflected in the App’s recording guidance.

Valeur AS may use creative and technical judgment when selecting, cropping, adapting, stabilizing, color grading, mixing, or otherwise editing Submitted Content.

9. App User responsibilities

By using the App, entering an Event Token, recording videos, or submitting videos, you agree that:

  1. you will use the App only for lawful purposes;

  2. you will not upload content that is illegal, hateful, violent, sexually explicit, harassing, defamatory, threatening, privacy-invasive, discriminatory, abusive, or otherwise inappropriate;

  3. you will not upload spam, advertising, malware, malicious content, or content unrelated to the event;

  4. you will not upload content that infringes another person’s intellectual property, privacy, publicity, or other rights;

  5. you will not film people in private situations where they would reasonably expect not to be recorded;

  6. you are responsible for ensuring that you have any permission or right required to record and upload the videos you submit;

  7. you understand that your Submitted Content may be reviewed, edited, adapted, and included in the Final Video delivered to the Customer.

Valeur AS may remove, ignore, reject, or delete Submitted Content if we believe it is unlawful, abusive, irrelevant, technically unsuitable, privacy-invasive, or otherwise inconsistent with these Terms.

10. Customer responsibilities

The Customer is responsible for:

  1. choosing the correct Package and event details;

  2. providing accurate contact, billing, event, and delivery information;

  3. selecting a reasonable Event Window;

  4. distributing the Event Token responsibly;

  5. informing guests and participants that videos may be submitted through Evig and used in an edited event video;

  6. ensuring that filming is permitted at the event and venue;

  7. obtaining any consent, permission, or clearance required from guests, participants, performers, speakers, venues, or others;

  8. ensuring that the event and use of Evig comply with applicable law;

  9. ensuring that Submitted Content is sufficient and suitable for Valeur AS to create the Final Video;

  10. being responsible for how the Final Video is shared, published, or used after delivery.

Valeur AS is not responsible if the Customer fails to inform guests, obtain necessary permissions, provide accurate event details, distribute the Event Token appropriately, or encourage enough suitable submissions.

11. Submitted Content and permission to use it

App Users retain any rights they may have in their Submitted Content.

By submitting content through Evig, the App User grants Valeur AS a non-exclusive, worldwide, royalty-free permission to store, process, review, edit, adapt, crop, color grade, sound mix, reproduce, combine, synchronize, include, export, and otherwise use the Submitted Content for the purpose of providing the Evig service, creating the Final Video, delivering the Final Video to the Customer, maintaining security, handling support requests, and complying with legal obligations.

This permission is necessary for Valeur AS to provide the service.

If an App User requests deletion of their Submitted Content before final delivery, Valeur AS will handle the request as described in our Privacy Policy. If deletion is technically possible and legally required, the relevant Submitted Content may be excluded from the Final Video.

After final delivery, Valeur AS cannot control copies of the Final Video already delivered to the Customer.

12. Selection of clips and creative discretion

Valeur AS is not required to use any specific Submitted Content in the Final Video.

We may reject, ignore, remove, or choose not to use Submitted Content that is, in our judgment, technically unsuitable, corrupt, low quality, poorly lit, unstable, too noisy, incorrectly framed, irrelevant, offensive, unlawful, privacy-invasive, or inconsistent with the intended Final Video.

The Final Video is created using Valeur AS’s professional and creative judgment. Customers may submit preferences, wishes, or style notes, but we do not guarantee that all requests will be followed.

13. Quality of submitted videos

The quality and content of the Final Video depends heavily on the videos submitted by App Users.

If the submitted videos are limited, low quality, technically unusable, poorly lit, unstable, noisy, incorrectly framed, irrelevant, or otherwise unsuitable, Valeur AS will use reasonable efforts to create the best possible Final Video from the available material.

However, poor or insufficient Submitted Content does not entitle the Customer to a refund, discount, free revision, or other compensation.

Valeur AS does not guarantee that the Final Video will include any specific person, moment, clip, sequence, song, style, quote, or creative choice.

14. Editing, color, sound, and subtitles

Unless otherwise stated in the Package description, the Final Video may include editing, sound mixing, color grading, music, and other creative production work at Valeur AS’s discretion.

Subtitles are not included unless Valeur AS chooses to include them for creative reasons or they are expressly included in the purchased Package.

Project files, timelines, editing files, work files, and production files are not included and will not be delivered to the Customer.

15. Music

Customers may submit music preferences or requests.

Final music selection depends on creative, technical, licensing, platform, and delivery considerations. Valeur AS may use licensed music, royalty-free music, production music, platform-safe music, public-domain music, customer-provided music, or other music where we determine that the intended use is appropriate for the service.

Unless otherwise agreed in writing, the Final Video is delivered for personal, non-commercial use only.

The Customer is responsible for how and where the Final Video is shared, uploaded, published, displayed, or otherwise used after delivery, including ensuring that their use complies with any applicable copyright rules, music rights, platform terms, and local laws.

Customer-requested commercial use, advertising use, public campaign use, broadcast use, paid promotion, or other non-personal use requires prior written agreement from Valeur AS and may require additional licensing.

16. Personal, non-commercial use

Unless otherwise agreed in writing, the Customer receives a personal, non-commercial license to use the Final Video.

The Customer may download, save, watch, and privately share the Final Video for personal purposes.

The Customer may post or share the Final Video publicly on social media or online platforms at their own responsibility, subject to applicable platform rules, copyright rules, privacy obligations, and other laws.

The Customer may not use the Final Video for paid advertising, commercial campaigns, business promotion, resale, licensing, broadcast, or other commercial purposes without written permission from Valeur AS.

17. Ownership and rights

App Users retain any rights they may have in their Submitted Content.

Valeur AS owns or retains the rights in its editing work, creative arrangement, production work, project files, workflows, templates, software, branding, and other materials created or used in providing the service.

The Customer receives the license to use the delivered Final Video as described in these Terms.

Raw uploaded videos, project files, editing files, internal notes, and production files are not included in the Customer’s purchase.

18. Marketing and portfolio use

Valeur AS may ask the Customer for permission to use the Final Video or excerpts from it for portfolio, marketing, website, social media, promotional, or case study purposes.

Valeur AS will not publicly use identifiable Final Videos or excerpts for marketing without Customer approval.

Anonymized or non-identifying references to the type of project may be used unless the Customer objects.

19. Purchase, payment, and taxes

Payment is normally made upfront through the Website using the available payment methods at checkout.

Payments may be processed by third-party payment providers, such as Squarespace, Stripe, PayPal, Vipps, or other providers made available at checkout.

Prices, package details, currency, taxes, and any applicable VAT/MVA are shown at checkout.

Norwegian customers may be charged Norwegian VAT/MVA where applicable. Other customers may be charged according to the tax setup shown at checkout. The Customer is responsible for providing accurate billing and location information.

Valeur AS may correct obvious pricing errors, technical errors, or checkout errors.

20. Consumer rights and cancellation

If you purchase as a consumer, you may have mandatory rights under applicable consumer law. Nothing in these Terms limits any mandatory rights you may have as a consumer.

Customers may cancel their purchase and receive a refund if the cancellation request is received by Valeur AS at least 14 days before the Event Window starts, unless otherwise required by applicable law.

Cancellation requests must be sent to support@evig.co.

If the Event Window starts in less than 14 days, or if Valeur AS has already started preparing, setting up, personalizing, or delivering the service, cancellation and refund rights may be limited to the extent permitted by applicable law.

At checkout, Valeur AS may ask the Customer to expressly request that the service begins before any statutory withdrawal period has expired, including creation of the Event Token, event setup, reservation of production capacity, and preparation of the service. The Customer may also be asked to acknowledge that this can affect their withdrawal or cancellation rights to the extent permitted by applicable law.

If payment processing fees, currency conversion fees, or other third-party fees are not refunded to Valeur AS by the payment provider, Valeur AS may deduct such non-refundable fees from any discretionary refund where permitted by law.

21. Event cancellation

If the event is cancelled and the Customer contacts Valeur AS at least 14 days before the Event Window starts, the Customer may receive a refund.

If the event is cancelled less than 14 days before the Event Window starts, refunds are not guaranteed and may be handled case by case, subject to applicable mandatory consumer law.

Valeur AS may, at its discretion, offer goodwill solutions such as rescheduling, credit, partial refund, or other alternatives, but is not obligated to do so unless required by law.

22. No refund for poor submitted material or subjective dissatisfaction

Valeur AS does not provide refunds merely because the Customer is not satisfied with the Final Video where the dissatisfaction is caused by subjective preference, unrealistic expectations, poor Submitted Content, insufficient Submitted Content, missing moments, low guest participation, technical quality of submitted clips, or similar circumstances outside Valeur AS’s reasonable control.

Valeur AS will use reasonable efforts to create the best possible Final Video from the available material, but the Customer is responsible for ensuring that guests are informed and encouraged to submit sufficient and suitable videos.

23. Wrong details or customer mistakes

If the Customer provides incorrect event details, wrong dates, wrong times, wrong orientation, wrong contact details, billing errors, or other incorrect information, the Customer must contact support@evig.co as soon as possible.

Valeur AS will use reasonable efforts to help correct the issue where possible, but we are not responsible for problems caused by incorrect information provided by the Customer.

Changes may not be possible after the Event Token has been created, the Event Window has started, or production work has begun.

24. Delivery

Unless otherwise stated in the Package description, Valeur AS aims to deliver the Final Video by download link within an estimated 3–4 weeks after the Event Token closes.

Delivery times are estimates and may be affected by project size, amount of Submitted Content, technical issues, missing information, unusually large events, subcontractor availability, illness, force majeure, music/licensing considerations, or other circumstances outside Valeur AS’s reasonable control.

Valeur AS may extend the delivery timeline where reasonably necessary.

The Final Video will normally be delivered by download link to the Customer.

The download link will normally remain available for 30 days after delivery. The Customer is responsible for downloading and safely storing the Final Video before the link expires.

25. Revisions

Unless expressly included in the purchased Package, revisions are not included.

A revision means any requested change to the Final Video after delivery, including changes to music, pacing, clip selection, structure, timing, color, sound, text, or other creative or technical elements.

Valeur AS may, at its discretion, make small changes as a goodwill gesture, but is not obligated to provide revisions unless they are included in the Package or agreed in writing.

Major changes, re-edits, new concepts, new music choices, new creative direction, added videos after token closing, or other extensive changes are not included unless separately agreed.

26. App permissions and technical requirements

The App may require access to the camera and microphone to record videos.

The App may also request access to the camera roll or photo library if the User chooses to save videos locally or use related device features.

Using the App requires a compatible device, sufficient storage, a working camera and microphone, internet access, and any required permissions.

Uploads may continue in the background where supported, but upload speed and reliability may be better when the App remains open and connected to the internet. Users should ensure that videos are fully uploaded before closing the App, disconnecting from the internet, deleting the App, or leaving the event.

Valeur AS is not responsible for failed or incomplete uploads caused by poor internet connection, device limitations, revoked permissions, insufficient storage, battery issues, operating system limitations, app interruption, user error, or circumstances outside our reasonable control.

27. Availability and changes to the App

Valeur AS may update, modify, suspend, or discontinue parts of the App, Website, Packages, features, or service at any time.

We do not guarantee that the App or Website will always be available, uninterrupted, error-free, or compatible with every device or operating system.

We may make changes for technical, security, legal, operational, or business reasons.

28. Prohibited use

You must not:

  1. misuse the App, Website, Event Token, or service;

  2. attempt to gain unauthorized access to Evig systems or uploaded content;

  3. interfere with uploads, storage, security, or other users;

  4. reverse engineer, copy, resell, or commercially exploit the App or service;

  5. use Evig to upload unlawful, abusive, infringing, or privacy-invasive content;

  6. use Evig in a way that violates applicable law or these Terms;

  7. attempt to bypass Package limits, Event Window restrictions, security features, or access controls.

Valeur AS may suspend, restrict, or terminate access if we reasonably believe these Terms have been violated.

29. Privacy

By using Evig, you acknowledge that you have read the Privacy Policy.

The Privacy Policy explains how Valeur AS processes data related to the App, Website, Customers, App Users, Submitted Content, Event Tokens, and Final Videos.

30. Deletion of videos and data

Deletion requests should be sent to privacy@evig.co.

To locate relevant uploads, Valeur AS may need information such as the Event Token and the relevant device/app identifier.

Where technically possible and legally required, Valeur AS may delete Submitted Content linked to the requesting App User before final delivery. Deletion may result in that App User’s videos being excluded from the Final Video.

After final delivery, Valeur AS cannot control copies already delivered to the Customer or copies shared by the Customer or others.

Raw uploaded videos may be deleted after project completion, delivery, acceptance, or expiry of the applicable retention period, as described in the Privacy Policy.

31. Subcontractors and service providers

Valeur AS may use employees, part-time workers, subcontractors, editors, color graders, sound mixers, technical providers, hosting providers, payment providers, and other service providers to provide Evig.

Such parties may access Submitted Content, project files, Customer information, or other materials only where necessary to provide, support, secure, or improve the service.

Valeur AS remains responsible for choosing service providers and subcontractors appropriate for the service.

32. Third-party services

Evig may rely on third-party services such as Firebase, Squarespace, Stripe, PayPal, Vipps, hosting providers, payment processors, storage providers, delivery tools, and other operational providers.

Use of third-party services may also be subject to those providers’ own terms, privacy notices, technical limitations, and availability.

Valeur AS is not responsible for third-party service interruptions, payment provider issues, platform restrictions, app store issues, internet outages, or other external technical problems outside our reasonable control.

33. Intellectual property

The Evig name, brand, App, Website, design, software, workflow, user interface, text, graphics, templates, processes, and related materials are owned by or licensed to Valeur AS.

You may not copy, modify, distribute, sell, reverse engineer, or exploit Evig materials except as permitted by these Terms or applicable law.

34. Limitation of liability

To the fullest extent permitted by applicable law, Valeur AS is not liable for indirect losses, loss of profit, loss of revenue, loss of opportunity, loss of goodwill, loss of data, reputational harm, platform takedowns, third-party claims, or consequential damages.

To the fullest extent permitted by applicable law, Valeur AS’s total liability for claims related to a purchased Package is limited to the amount paid by the Customer for that Package.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot be excluded under mandatory consumer law.

35. Force majeure

Valeur AS is not responsible for delay or failure to perform caused by events outside our reasonable control, including but not limited to illness, accidents, strikes, labor disputes, internet outages, hosting failures, payment provider failures, app store issues, cyberattacks, fire, flood, natural disasters, war, terrorism, government restrictions, legal changes, or other force majeure events.

If such an event occurs, Valeur AS may extend delivery timelines or suspend performance for as long as reasonably necessary.

36. Mandatory consumer rights

Nothing in these Terms limits any mandatory rights you may have as a consumer under applicable law.

If any part of these Terms conflicts with mandatory consumer protection rules that apply to you, those mandatory rules will apply instead.

37. Changes to these Terms

Valeur AS may update these Terms from time to time.

The updated Terms will be posted on the Website with a new “Last updated” date.

The Terms in force at the time of purchase normally apply to that purchase, unless changes are required by law, security, technical reasons, or otherwise permitted by applicable law.

Continued use of the App or Website after updated Terms are posted means you accept the updated Terms.

38. Governing law and disputes

These Terms are governed by Norwegian law, except where mandatory consumer protection rules in another country apply.

If a dispute cannot be resolved informally, disputes may be brought before the Norwegian courts. Where permitted by law, Oslo District Court shall be the legal venue.

If you are a consumer, you may also have the right to bring claims in your country of residence or through applicable consumer dispute resolution bodies.

40. App entry wording

The App may display the following or similar wording before a User enters an Event Token:

“By entering a valid token, you agree to the Evig Terms & Conditions and acknowledge the Evig Privacy Policy.”

By entering an Event Token and using the App, the User agrees to these Terms.
